Hey everyone! I need you opinions on my problem! Ok so I am currently going through a divorce with the wife. There is involved. Since she filed for divorce before the was born, my attorney and I decided to have Genetic Testing ordered (just to be safe). It was ordered on May 18, 2010 to be completed upon birth of the . The was born on July 02, 2010. We had another hearing on August 3, 2010 because she motioned a second time for spousal & support. They denied both because paternity had not been established. The court ordered again for the genetic testing. The genetic testing was set up for September 02, 2010. According to the order from the Support Enforcement Agency (CSEA) we were both ordered to appear on that date. I ed the CSEA on September 07, 2010 and the genetic testing had not been completed by my wife. I notified my attorney and he submitted a “Motion for Contempt” against my wife. The court granted the motion and set up the hearing date for late October. We had a pre-trial on September 13, 2010 and by this point the genetic testing was still not completed by her. She also received notification from her attorney on this day about the motion for contempt. The Judge on the pre-trial hearing is also the same Judge that signed the motion. Nothing was accomplished this day because no paternity was yet established. This past Friday I received a letter from my attorney which had a copy of a letter from her attorney. It advised that she completed the genetic testing on September 16, 2010. This is three days after she found out about the contempt motion and after it was ordered by the court a few times. Her attorney stated that since she complied (by which I’m sure he means she complied by finally getting it done) the motion for contempt hearing is not necessary. Again, that was from her attorney. My gut instincts are to continue with the motion for contempt hearing because all she has done it waste my time, attorneys time, and the courts time. Even my family says to not drop the motion because if the tables were turned, they would try to have me hung!!!!! Would you continue on with the contempt motion???
